__ 1. Vehicle Title & Registration: Vehicle(s) will be titled exactly as listed above. Any changes post-sale will incur a $35 document fee plus any applicable title correction fees. Buyer is responsible for providing accurate information.

__ 2. Payment Terms: All purchases must be PAID IN FULL by the end of sale night or no later than 12:00 PM the next business day. No financing is offered. No vehicle may be moved from the property until payment is received in full.

__ 3. Late Payment Fee: A $50/day late fee will be charged on any vehicle not paid within the time frame stated above.

__ 4. Accepted Payment Methods: Cash, certified funds, or credit/debit card (3% surcharge).

__ 5. Deposit Requirement: A $400 cash deposit is required for each vehicle you intend to bid on. If no vehicle is purchased, your deposit is refundable only upon returning your bidder badge and providing matching identification by the end of sale night.

__ 6. Vehicle Sale Withdrawal / Non-Payment: If you win a vehicle and back out, fail to pay, or attempt to void the sale for any reason, you FORFEIT your $400 deposit. No exceptions.

__ 7. Insurance Requirement: Buyer must show proof of valid insurance on another vehicle registered to them, or purchase insurance on the newly acquired vehicle before it may leave DAE property. Insurance from other individuals is not accepted unless they are listed as a co-buyer or the vehicle is officially added to their policy with proof.

__ 8. Title Delay Policy: Some vehicles are sold with a title delay. The seller has 21 business days to provide the title. While DAE attempts to enforce this, there is no guarantee on exact title delivery timing. Buyer assumes risk. No reimbursements will be provided for repair or transportation costs in the event a title cannot be produced.

__ 9. Temporary Tag: All public buyers will receive a 30-day temporary tag, included in the buyer’s fee.

__ 10. All Sales Are Final: Vehicles are sold AS IS, with NO warranty, NO return, and NO exchange. Once you win the bid, the vehicle is yours, period.

__ 11. Right to Refuse Service: Delaware Auto Exchange reserves the right to deny service to any individual for any reason, including but not limited to prior violations of policy, suspicious behavior, or abuse of auction privileges.

__ 12. Limitation of Liability, Dispute Resolution & Fee Recovery: By signing this agreement, the Buyer agrees to release and hold harmless Delaware Auto Exchange, its owners, employees, agents, and affiliates from any and all claims, damages, or liabilities arising from participation in the auction. If a buyer initiates any legal action or arbitration against Delaware Auto Exchange and does not prevail, the buyer agrees to reimburse all legal fees, attorney costs, filing fees, and any associated expenses incurred by Delaware Auto Exchange in defense of such action. Buyer also waives the right to pursue class action claims and agrees that all claims must be brought individually.

__ 13. Non-Payment and Collections Policy: If the Buyer fails to pay for any vehicle won at auction within the required timeframe, Delaware Auto Exchange reserves the right to pursue all available legal remedies, including but not limited to legal action and referral to a licensed collection agency. Buyer will be responsible for all legal fees, collection costs, and any additional expenses incurred. Non-payment may also result in negative credit reporting.

__ 14. Surveillance and Media Consent: Buyer acknowledges and agrees that Delaware Auto Exchange uses security cameras and audio/video monitoring throughout the facility. By entering the property and participating in any auction, Buyer consents to being recorded. Buyer also consents to being photographed or filmed and understands that images or video may be used on social media, marketing materials, or published on platforms including, but not limited to, the auction owner's YouTube channel. No compensation will be provided for such use.

__ 15. Bidder Badge Misuse: Your bidder badge is assigned exclusively to you and is not transferable. Any attempt to use another person’s badge, or allow another person to use yours, will result in immediate forfeiture of deposit and potential ban.

I/We acknowledge that DAE is a private business and not a public entity. Participation in auctions is a privilege, not a right.

FINAL DISCLOSURE & AGREEMENT:

All terms and conditions listed above, announced, or posted on Delaware Auto Exchange property. I/We understand that any violation of these terms, failure to pay for vehicle(s), or misuse of bidder privileges may result in forfeiture of deposit(s), permanent banning from Delaware Auto Exchange, and legal action. I/We understand that the bidder badge is my responsibility and must be returned to receive any deposit refund. I/We affirm that all provided information is accurate and complete.
